US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation stems from a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his return to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her order, the court noted that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
